The Folder Proved the HOA Never Owned the Road

Inside were sixteen years of canceled checks, signed receipts, emails, surveys, and letters from every previous HOA president.

Each January, they had acknowledged the same thing:

Their subdivision was using my road with permission.

That single fact gutted Delphine’s prescriptive-easement argument. Continuous use was not enough if the owner had repeatedly granted permission and the HOA had paid for that privilege.

Then came the tree.

My survey showed the juniper stood well inside my boundary. Photographs documented the granite marker before Delphine’s excavator destroyed it, and an arborist later valued the loss.

I stopped arguing with her personally.

My attorney sent notice terminating the HOA’s temporary road license and demanding payment for the unauthorized work.

Meanwhile, a neighboring tribal nation that had approached me years earlier about conservation acreage renewed its offer for the ranch.

I sold.

Not because selling magically erased state law—it didn’t.

But once the disputed access claim failed and the old permission ended, the subdivision had no automatic right to keep crossing private property. The new owners installed gates while the HOA scrambled to negotiate another lawful route.

When Delphine returned with contractors and tried entering despite written notice, law enforcement responsible for the property handled it from there.

Her “new road” never happened.

The subdivision eventually negotiated access elsewhere at considerable expense.

Delphine had believed sixteen years of kindness had transformed my land into hers.

The folder proved the opposite.

For sixteen years, every payment had been evidence that the road was never theirs at all.
